This course adopts a practical and comparative approach to class actions. While focused primarily on Quebec, provincial common law systems, the United States and other jurisdictions will also be examined. Particular attention will be given to the practice of class actions from the viewpoint of plaintiff and defendant lawyers, especially regarding how a class action is initiated, analyzed and litigated. Students will be required to participate actively by expressing opinions, drafting pleadings, and at the end of the term, helping argue for class action approval. Field experts will also be invited to comment on key issues.
